Agreement to Terms

By accessing or using Daycare Compliance Management services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

Description of Service

Daycare Compliance Management provides a managed service for organizing and tracking compliance paperwork for licensed California daycares. Our service includes:

• Setting up digital compliance record structures
• Organizing documentation according to California Title 22 requirements
• Reviewing records and flagging missing or expiring documents
• Tracking renewal dates and required updates
• Sending notifications when action is needed

What We Do NOT Provide

Our service explicitly does NOT include:

• Conducting inspections or attending on-site visits
• Providing legal advice or regulatory consulting
• Creating, certifying, or verifying facility-specific information
• Guaranteeing inspection outcomes or compliance status
• Assisting with license applications or pre-licensing requirements
• Interacting with licensing analysts or inspectors on your behalf
• Post-citation remediation or compliance plan consulting

Eligibility

Our services are only available to currently licensed California daycares (child care centers and family child care homes). You must be at least 18 years old and authorized to enter into this agreement on behalf of your daycare.

Your Responsibilities

You are responsible for:

• Providing accurate and complete information about your daycare
• Uploading requested documents in a timely manner
• Verifying the accuracy of facility-specific information
• Maintaining compliance with all California licensing requirements
• All on-site operations and day-to-day compliance activities
• Responding to licensing inspections and communications
• Keeping your account information and contact details current

Payment Terms

Our service is offered at $1,500 per year, paid in full at the time of signup. Payment is processed through Stripe. By purchasing our service, you agree to pay all applicable fees.

Refunds: Given the nature of our service (immediate setup and organization of your records), refunds are provided at our discretion and only in cases where services have not been rendered.

Service Level

We will make reasonable efforts to:

• Set up your compliance records within 1 business day of receiving your intake information
• Review uploaded documents within a reasonable timeframe
• Send notifications for expiring documents and upcoming deadlines
• Respond to your questions and support requests

However, we do not guarantee uninterrupted or error-free service, and we are not liable for delays outside our reasonable control.

Limitation of Liability

IMPORTANT: Our service organizes and tracks paperwork. We do not guarantee compliance with California regulations, successful inspections, or the accuracy of information you provide.

To the fullest extent permitted by law, Daycare Compliance Management shall not be liable for:

• Citations, deficiencies, or violations issued by California Community Care Licensing
• License suspensions, revocations, or other enforcement actions
• Fines, penalties, or compliance plans resulting from inspections
• Inaccurate or incomplete information you provide
• Your failure to upload documents or respond to our notifications
• Loss of business, revenue, or reputation
• Indirect, incidental, or consequential damages

Our total liability to you for any claim arising from our services shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• Our service will meet your specific compliance needs
• Your records will be found satisfactory during inspections
• The service will be uninterrupted, timely, secure, or error-free
• Any errors in the service will be corrected

Indemnification

You agree to indemnify and hold harmless Daycare Compliance Management from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms of Service
• Your violation of any law or regulation
• Inaccurate information you provide
• Your on-site operations and compliance activities

Data and Privacy

Your use of our services is also governed by our Privacy Policy. We store your compliance documentation securely, but you retain ownership of all documents you upload. We may access your records to provide our services but will not share them with third parties except as described in our Privacy Policy.

Termination

Either party may terminate this agreement at any time. Upon termination:

• You will lose access to your organized compliance records
• We will cease tracking and notification services
• You may request a copy of your uploaded documents (subject to reasonable fees for retrieval)
• No refunds will be provided for unused service time

Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our services after changes take effect constitutes acceptance of the modified terms.

Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Daycare Compliance Management regarding our services.
